Welcome to qrder. These Terms of Service ("Terms") govern your use of the qrder platform and services. By accessing or using qrder, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account or using any part of the qrder platform ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. These Terms apply to all visitors, users, and others who access or use the Service.

If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

qrder is a software-as-a-service (SaaS) platform that enables restaurants and food service businesses to create and manage digital menus accessible via QR codes. Our Service includes menu creation and management tools, QR code generation, order management capabilities, kitchen display systems, table management, and related business tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately at support@qrder.io of any unauthorized use of your account or any other security breach.

4. Subscription and Payment

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase. All fees are quoted in the currency indicated at checkout.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms. We reserve the right to change subscription fees with 30 days' prior notice.

5. Acceptable Use

You agree not to use the Service to: upload or share content that is unlawful, harmful, threatening, abusive, or infringes on third-party rights; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the Service or its infrastructure; use the Service for any purpose that violates applicable laws or regulations; transmit malware, viruses, or other harmful code; scrape, crawl, or use automated means to access the Service without our prior consent.

We reserve the right to investigate and take appropriate action against anyone who violates this provision, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by qrder and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Nothing in these Terms grants you any right to use the qrder name, logos, domain names, or other distinctive brand features.

7. User Content

You are responsible for all content you upload, post, or otherwise make available through the Service, including but not limited to menu items, descriptions, images, pricing information, and business details ("User Content").

By uploading User Content, you grant qrder a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or your account.

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your User Content does not infringe any third party's intellectual property or other rights.

8. Limitation of Liability

To the maximum extent permitted by applicable law, qrder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

Our total aggregate liability for any claim arising from or related to these Terms or the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No advice or information, whether oral or written, obtained from qrder shall create any warranty not expressly stated in these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. You may export your data before termination through your account settings. We will retain your data for 30 days after termination, after which it will be permanently deleted.

You may terminate your account at any time through your account settings or by contacting us at support@qrder.io.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we may also send you a notification via email or through the Service.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
